TERMS & CONDITIONS, SHIPPING, REFUND & OTHER POLICIES

Welcome to Writersgram.

These Terms & Conditions and Policies (“Terms”, “Agreement” or “Policy”) govern your access to and use of the Writersgram website, services, products and publishing-related offerings available through writersgram.com (“Website”).

Writersgram is a sole proprietorship business owned and operated by Deepanshu Gupta (“Writersgram”, “we”, “us”, “our” or “Company”), having its principal place of business in India.

By accessing the Website, placing an order, purchasing any service, submitting a manuscript or other content, or otherwise using Writersgram’s services, you acknowledge that you have read, understood and agreed to these Terms.

If you do not agree with any part of these Terms, please do not use the Website or our services.


1. ABOUT WRITERSGRAM

Writersgram provides services and products relating to authors, writers and publishing, which may include, depending upon the applicable offering:

  • Book publishing and self-publishing support;
  • ISBN and publishing assistance;
  • Editing, proofreading, formatting and typesetting;
  • Cover design and related creative services;
  • Printing and physical copies of books;
  • Distribution and listing assistance;
  • Author copies and bulk printing;
  • E-books and digital publishing;
  • Marketing and promotional services;
  • Writing, editorial and content-related services; and
  • Other services or products described on the Website.

The exact scope, deliverables, timelines and pricing of a particular service shall be determined by the relevant service description, quotation, order confirmation, proposal or written communication issued by Writersgram.


2. ELIGIBILITY

By using the Website or purchasing our services, you represent that:

  1. You are legally capable of entering into a binding agreement under applicable law;
  2. The information provided by you is accurate and complete;
  3. You have the authority to submit any material, manuscript, artwork, photograph, document or other content provided to Writersgram; and
  4. Your use of Writersgram does not violate any applicable law or the rights of any third party.

If you are purchasing services on behalf of an organisation or another person, you represent that you have the authority to do so.


3. ORDERS AND SERVICE ENGAGEMENTS

A service or product becomes an accepted order only after Writersgram has received the applicable payment or otherwise confirmed the engagement in writing.

Website descriptions, illustrations, examples and indicative timelines are provided for general guidance and may not represent the exact final deliverable.

Writersgram may contact you for additional information, clarification, approvals, files or documents required to complete your order.

If required information or approvals are delayed by the customer, the delivery or completion timeline may be extended accordingly.


4. PRICING AND PAYMENTS

All prices displayed on the Website or communicated by Writersgram are subject to the terms specified at the time of purchase.

Unless expressly stated otherwise:

  • Prices are in Indian Rupees (INR);
  • Applicable taxes, including GST where applicable, may be charged in addition to the stated price;
  • Payment must be made through the payment methods made available by Writersgram;
  • An order may not be processed until the required payment has been successfully received; and
  • Writersgram reserves the right to change its pricing, packages or service offerings prospectively.

For customised projects, the applicable quotation or proposal shall prevail over general pricing information appearing on the Website.


5. AUTHOR / CUSTOMER CONTENT

For the purposes of these Terms, “Customer Content” includes manuscripts, books, text, photographs, illustrations, artwork, logos, designs, images, videos, documents, metadata and other materials supplied by you.

You retain ownership of the intellectual property rights that you own in your Customer Content.

By submitting Customer Content to Writersgram, you grant Writersgram a limited, non-exclusive, royalty-free licence to use, reproduce, store, process, format, edit, transmit and distribute such content only to the extent reasonably necessary to provide the services requested by you.

You represent and warrant that:

  • You own or have obtained all necessary rights and permissions in the content submitted by you;
  • Your content does not knowingly infringe copyright, trademark, privacy, publicity or other rights of any person;
  • Your content does not contain unlawful, defamatory, fraudulent, obscene or otherwise prohibited material;
  • Any quotations, photographs, artwork, fonts or third-party material used in your work have the necessary permissions or licences; and
  • You are responsible for the legal consequences of content supplied by you.

Writersgram is not responsible for infringement claims arising from material supplied by a customer.


6. INTELLECTUAL PROPERTY OF WRITERSGRAM

The Writersgram name, logo, Website design, graphics, original text, software, processes, templates, branding, layouts and other materials created or owned by Writersgram remain the property of Writersgram or its respective licensors.

You may not copy, reproduce, modify, distribute, sell, reverse engineer or commercially exploit Writersgram’s proprietary materials without prior written permission.

Where Writersgram creates a specific deliverable for you under a paid service, ownership and usage rights shall be governed by the applicable service agreement or quotation. Where no separate terms are provided, payment for the applicable deliverable grants you the right to use the final approved deliverable for its intended purpose, subject to any third-party licences and rights.


7. EDITING, PROOFREADING AND CREATIVE SERVICES

Editing, proofreading, formatting, cover design and similar services involve professional judgement and creative interpretation.

Unless expressly guaranteed in writing:

  • Writersgram does not guarantee that a manuscript will be completely free from every grammatical, typographical or formatting error;
  • Editorial changes are not a guarantee of commercial, literary or critical success;
  • Design concepts may involve reasonable creative interpretation of the customer’s brief;
  • Customers may be required to provide approvals before finalisation; and
  • Once a customer approves a final proof or design, subsequent changes may attract additional charges.

Where the customer requests substantial revisions after approval, Writersgram may treat such revisions as a new or additional service.


8. PUBLISHING AND DISTRIBUTION

Where Writersgram assists with publication or distribution of a book, the availability of the book through any third-party platform, marketplace, distributor, bookstore or retailer is subject to the policies and operational decisions of that third party.

Writersgram does not guarantee:

  • A particular sales volume;
  • A particular ranking or bestseller status;
  • A specific number of reviews;
  • Acceptance by any third-party retailer or distributor;
  • Continued availability of a listing on a third-party platform; or
  • Any particular amount of royalties or revenue.

Third-party platforms may change their policies, pricing, catalogue requirements, delivery arrangements or availability without notice.

Where Writersgram is providing distribution assistance, Writersgram’s role may be limited to facilitating submission, listing, metadata management or other agreed services.


9. BOOK PRINTING

Printed books are manufactured according to the specifications applicable to the relevant order.

Minor variations in:

  • Colour;
  • Paper;
  • Binding;
  • Trimming;
  • Print positioning;
  • Cover finish; or
  • Other physical characteristics

may occur as a normal consequence of commercial printing and manufacturing processes.

Digital screens and physical printing processes may display colours differently. A colour appearing on a computer or mobile screen may not exactly match the final printed product.

Printing quantities, specifications and production timelines shall be based on the applicable order.


10. SHIPPING POLICY

Where physical products are ordered, Writersgram will arrange shipping through an appropriate courier or logistics provider.

Delivery Address

Customers are responsible for providing a complete and accurate delivery address, including:

  • Name of recipient;
  • House/building number;
  • Street/locality;
  • City;
  • State;
  • PIN code; and
  • Contact number where required.

Writersgram will not be responsible for delays, failed delivery or additional shipping charges caused by an incorrect or incomplete address supplied by the customer.

Delivery Timelines

Estimated delivery timelines communicated by Writersgram are indicative unless a specific delivery date has been expressly guaranteed in writing.

Delivery may be affected by:

  • Courier delays;
  • Weather or natural events;
  • Strikes;
  • Government restrictions;
  • Public holidays;
  • Incorrect address information;
  • Recipient unavailability;
  • Remote-location delivery;
  • Logistics disruptions; or
  • Other circumstances beyond Writersgram’s reasonable control.

Shipping Charges

Shipping charges, where applicable, will be communicated at the time of purchase or included in the applicable order price.

For bulk or unusually large orders, additional shipping or handling charges may apply.

International Shipping

International orders, where offered, may be subject to additional shipping charges, customs duties, import taxes, local fees or other charges imposed by the destination country.

Such charges are the responsibility of the customer unless expressly stated otherwise.


11. DAMAGED OR INCORRECT PRODUCTS

If a physical product arrives materially damaged or you receive an incorrect product, you should contact Writersgram as soon as reasonably possible and preferably within 48 hours of delivery.

You may be asked to provide:

  • Photographs or video of the package;
  • Photographs of the damaged product;
  • Order details;
  • Shipping label; and
  • Other information reasonably required to investigate the issue.

Where Writersgram determines that the product was materially damaged during fulfilment or that an incorrect product was supplied, Writersgram may, at its discretion, provide a replacement, reprint, refund or other appropriate resolution.

Minor manufacturing or printing variations that do not materially affect the usability of the product shall not automatically qualify as defects.


12. REFUND POLICY

Because many Writersgram services and products are customised or produced specifically for an individual customer, refund eligibility depends on the nature and stage of the order.

A. Digital / Customised Services

Payments for services that have already commenced may generally be non-refundable, particularly where Writersgram has already allocated professional resources, commenced work, created customised materials or incurred third-party costs.

Where a project has not yet commenced, Writersgram may consider a cancellation request on a case-by-case basis.

Any refund, where approved, may be reduced by:

  • Work already completed;
  • Third-party costs already incurred;
  • Payment gateway charges;
  • Administrative costs; and/or
  • Other non-recoverable expenses.

B. Printing Orders

Once a printing order has entered production, cancellation may not be possible.

Printed books and other customised products cannot ordinarily be returned merely because the customer has changed their mind, unless required under applicable law or the product is materially defective or incorrectly supplied.

C. Duplicate or Failed Payments

If you are charged more than once for the same transaction due to a technical or payment-processing issue, the duplicate amount will be reviewed and, where verified, refunded through the applicable payment method.

D. Refund Processing

Approved refunds will generally be processed through the original payment method where technically possible.

The time taken for the amount to reflect in the customer’s account may depend upon the payment gateway, bank or financial institution.


13. CANCELLATION POLICY

Cancellation requests should be made as soon as possible after placing an order.

A cancellation request does not automatically entitle the customer to a full refund.

The amount refundable, if any, will depend on:

  1. Whether work has commenced;
  2. The stage of production;
  3. Whether third-party services have been ordered;
  4. Whether customised materials have been created;
  5. Whether printing has commenced; and
  6. The specific terms applicable to the order.

Once a customised project has entered an irreversible stage of production, cancellation may not be possible.


14. AUTHOR APPROVALS

For publishing, editing, formatting, cover design and printing services, Writersgram may provide proofs, drafts or previews for customer approval.

The customer is responsible for carefully reviewing and approving:

  • Manuscript text;
  • Names;
  • Author details;
  • Copyright information;
  • ISBN information;
  • Book title;
  • Cover;
  • Formatting;
  • Metadata;
  • Pricing;
  • Distribution information; and
  • Other relevant information.

Once a customer provides final approval, Writersgram may proceed with publication, printing or submission.

Writersgram will not ordinarily be responsible for errors that were clearly visible in an approved proof and could reasonably have been identified before approval.


15. CONTENT RESTRICTIONS

Writersgram reserves the right to refuse, suspend or terminate a service involving content that it reasonably believes:

  • Violates applicable law;
  • Infringes third-party rights;
  • Is fraudulent or deceptive;
  • Promotes unlawful activity;
  • Contains abusive or threatening material;
  • Contains content that creates material legal or reputational risk for Writersgram; or
  • Otherwise violates these Terms.

Where reasonably practicable, Writersgram may inform the customer of the reason for such refusal.


16. THIRD-PARTY SERVICES AND PLATFORMS

Writersgram may use or interact with third-party providers, including payment gateways, courier companies, printing partners, distributors, marketplaces, hosting providers and other service providers.

Such third parties may have their own terms and policies.

Writersgram is not responsible for independent failures, policy changes, outages or decisions of third-party platforms beyond Writersgram’s reasonable control.


17. WEBSITE AVAILABILITY

We endeavour to keep the Website available and accurate. However, we do not guarantee that the Website will always be:

  • Available without interruption;
  • Free from technical errors;
  • Free from viruses or other harmful components; or
  • Completely accurate or current.

We may modify, suspend or discontinue any portion of the Website or its services without prior notice where reasonably necessary.


18. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Writersgram shall not be liable for indirect, incidental, consequential, special or punitive losses arising from the use of the Website or services.

Writersgram’s liability, where legally applicable, shall ordinarily be limited to the amount actually paid by the customer to Writersgram for the specific service giving rise to the claim.

Nothing in these Terms is intended to exclude or limit any liability that cannot lawfully be excluded or limited under applicable law.


19. INDEMNIFICATION

You agree to indemnify and hold harmless Writersgram, its proprietor, employees, contractors and service providers from claims, losses, liabilities, damages, costs and expenses arising out of:

  • Your breach of these Terms;
  • Your Customer Content;
  • Alleged infringement of third-party intellectual property rights;
  • Your violation of applicable law; or
  • Your misuse of the Website or services.

20. PRIVACY

Writersgram may collect and process information necessary to operate the Website, process orders, provide services, communicate with customers, arrange delivery and maintain business records.

Personal information will be handled in accordance with applicable Indian law and Writersgram’s privacy practices.

By using the Website, you consent to the collection and use of information reasonably necessary for providing the requested services.


21. COMMUNICATIONS

By placing an order or submitting an enquiry, you agree that Writersgram may contact you regarding:

  • Your order;
  • Payments;
  • Manuscript or project requirements;
  • Proofs and approvals;
  • Shipping;
  • Customer support; and
  • Other communications reasonably connected with your use of Writersgram.

Promotional communications, where applicable, may be managed in accordance with applicable law.


22. FORCE MAJEURE

Writersgram shall not be responsible for failure or delay caused by circumstances beyond its reasonable control, including natural disasters, pandemics, war, government actions, strikes, transportation disruptions, internet or infrastructure failures, third-party outages, fires, floods or other similar events.


23. CHANGES TO THESE TERMS

Writersgram may update these Terms from time to time.

The updated version will be published on this Website with a revised effective date.

Your continued use of the Website after an updated version becomes effective constitutes acceptance of the revised Terms, to the extent permitted by applicable law.


24. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and interpreted in accordance with the laws of India.

Subject to any mandatory rights or remedies available to consumers under applicable law, disputes arising in connection with these Terms or Writersgram’s services shall be subject to the jurisdiction of the competent courts having jurisdiction over New Delhi, India.

Nothing in these Terms is intended to take away any mandatory statutory rights available to a consumer under applicable law.


25. SEVERABILITY

If any provision of these Terms is determined to be invalid, unlawful or unenforceable, the remaining provisions shall continue to remain in effect to the extent permitted by law.


26. ENTIRE AGREEMENT

These Terms, together with any applicable quotation, proposal, order confirmation or specific service agreement, constitute the understanding between you and Writersgram concerning the relevant services.

Where a specific written agreement expressly conflicts with these general Terms, the specific written agreement shall prevail for that particular service or transaction.
